The Essentials

Federal regulation article 65 expressly prohibits smoking in guest bedrooms at lodging establishments. A hotel’s own permission cannot create a bedroom exception under this rule.
Applies in: Mexico

Article65 Bis lists balconies within collective-concurrence spaces, while article65 separately regulates lodging bedrooms and public/shared areas. The reviewed text does not clearly classify an exclusively private attached balcony. Shared-balcony restrictions and bedroom rules do not establish that exact private space’s permission.
Checked: 2 Nov 2026
Article65 bans smoking in bedrooms at places used for lodging. A serviced-apartment label alone does not resolve whether the exact private unit is lodging accommodation or a residential tenancy. No general bedroom permission follows from residential appearance; establish the unit’s legal classification and policy.
Checked: 2 Nov 2026
Federal article 65 prohibits smoking in lodging bedrooms and public/shared areas; any exclusively smoking zone must be outdoors and comply with article 60. A separate indoor hotel smoking room is not an ordinary lawful option.

An ordinary dining terrace is smoke-free: article 65 Bis includes terraces and food/drink venues. A separate compliant open-air smoking zone is a different arrangement and cannot offer service or food/drink consumption.
Applies in: Mexico

Membership alone creates no smoking exemption. Articles26–27 cover enclosed/workplace settings and free or restricted public access, with smoking zones outdoors only. The evidence does not establish an actual club’s legal classification, licence or visitor access; a generic bar exception cannot establish this arrangement.

No. Ordinary indoor customer areas are public‑access/workplaces and are 100% smoke‑free under federal law.

IMSS guidance contemplates smoking on open streets while respecting others. This does not override statutory smoke-free transport stops, collective-use areas or other protected places. An ordinary street is distinct from those settings; obey applicable signs and do not treat this as permission on beaches or restaurant terraces.

Outlook: Tightening
SHCP agreement179/2025 records enacted specific cigarette-tax stages: MXN0.8516 per cigarette in2026,0.9197 in2027,0.9932 in2028,1.0726 in2029 and1.1584 from2030. These are tax amounts, not retail pack prices or a new smoking-access ban. This bounded national finding does not establish the absence of other local changes.

Each answer shows its own check date and legal scope. Property policy, practical facilities and legal permission are checked separately. An edition date does not mean every claim was checked again.
Legally unclear means the question was researched but a reliable answer was not established. It is not permission.
