The Essentials
The essentials first. Tap any answer for its explanation, sources and check date.
The person controlling a hotel, motel or lodging establishment may designate up to 20% of guestrooms for smoking. Book an expressly smoking-designated room and confirm its policy; this legal allowance does not prove availability at a particular hotel.
Applies in: New Jersey
Checked: 2 Nov 2026
The reviewed law separates designated guestrooms from enclosed public/work areas, and the outdoor rules turn on enclosure and location. These sources do not clearly classify a separate private hotel balcony; confirm its exact legal status and hotel policy.
Applies in: New Jersey
Checked: 2 Nov 2026
The sources exempt private homes/residences and permit designated lodging guestrooms, but do not classify an unspecified serviced-apartment unit. Its actual legal accommodation category and operator policy must be established; a booking label is insufficient.
Applies in: New Jersey
Checked: 2 Nov 2026
A lawfully designated smoking guestroom is a usable indoor option where offered, within the 20% allowance. This does not establish a communal lounge or permission in ordinary hotel public areas.
Applies in: New Jersey
Checked: 2 Nov 2026
Smoking is prohibited in enclosed public passenger terminals under state law. No indoor airport smoking room or outdoor airport facility is established by this assessment.
Applies in: New Jersey

NJ TRANSIT’s Atlantic City rider guide prohibits smoking in stations and on platforms. This is the identified operator’s rule; it does not classify every other rail operator.
Operator policy: NJ TRANSIT Atlantic City Rail Line, including its stations and platforms
Checked: 2 Nov 2026
No smoking aboard NJ TRANSIT trains serving Atlantic City. The exact operator’s August 2026 guide states the prohibition; other operators require their own rules.
Operator policy: NJ TRANSIT Atlantic City Rail Line passenger trains

Ordinary indoor bars are smoke-free. A qualifying registered cigar bar or lounge is a narrow exception, requiring pre-2005 operation, continuing qualifying tobacco income and unchanged size/location; no particular venue is verified.
Applies in: New Jersey
Checked: 2 Nov 2026
Ordinary nightclub interiors are smoke-free. Calling a venue a club does not establish the registered cigar-bar or tobacco-retailer exception, and casino gaming-area permission is not nightclub permission.
Applies in: New Jersey
Checked: 2 Nov 2026
Ordinary indoor restaurant and dining areas are smoke-free. The casino gaming-perimeter exception does not create general restaurant smoking permission.
Applies in: New Jersey
Checked: 2 Nov 2026
Smoking can be allowed on an outdoor terrace that is not structurally enclosed and where the operator permits it. Apply the state’s opening-width and wall-opening tests; beaches, the Boardwalk, school grounds and public parks remain separately restricted.
Applies in: New Jersey
Checked: 2 Nov 2026
A membership label alone is not an exemption. Only a separately qualifying registered pre-2005 cigar bar/lounge or qualifying tobacco retailer can rely on those narrow exceptions; no club or its cigarette policy is verified.
Applies in: New Jersey
Checked: 2 Nov 2026
There is no general smoking-pub permission. Qualifying registered cigar bars/lounges and tobacco retailers have limited exemptions; registration, historic operation/income or retail criteria must be met. No individual establishment is verified.
Applies in: New Jersey
Checked: 2 Nov 2026
Ordinary open streets outside protected locations are not covered by the general enclosed-place ban. Do not smoke on the beach or Boardwalk, on school grounds or in public parks; obey applicable property restrictions and signs.
Applies in: Atlantic City

Before booking, confirm smoking permission for your exact room, balcony or shared area, including access hours.

Outlook: Tightening
The 2026 introduced texts S212 and S698 propose ending or restricting casino smoking. On 26 January the appeal court refused a preliminary injunction but reopened the case for further proceedings. These are proposals/litigation, not a new effective ban. No later outcome was identified in the bounded check; the latest procedural status is unconfirmed.

Each answer shows its own check date and legal scope. Property policy, practical facilities and legal permission are checked separately. An edition date does not mean every claim was checked again.
Legally unclear means the question was researched but a reliable answer was not established. It is not permission.

Smoking is prohibited in state, county and municipal public parks. The Act separately excludes golf courses and parking lots adjacent to but outside a park; these do not create park-wide smoking permission.
Applies in: New Jersey

Atlantic City’s beach and Boardwalk are smoke-free according to the city and police guidance. The state’s potential designated-beach-area exception is not proof that Atlantic City offers such an area.
